It is an Euonymus sp.

Thanks silver surfer - this helped a lot. Variety is Euonymus alatus 'Compactus'

Hmm!
Not sure that it is correct for Euonymus alatus compactus!
In theory this has winged stems... see....

Hard to id it accurately just from the leaves.
Maybe the seed pods will give further clues.

It is looking rather sickly.

could it be Leptospernum. More info required and two photos one from further back so we can gauge height, Is it strongly scented, is it deciduous, what time of year does it flower has it fruit.
