Could it be a buddleia ? Not that confident..............The flowers, when they happen, will help you identify it more easily.

i think med kneeivel is right it is a Forsythia but which species and variety.

Did this tree produce masses of yellow flowers early spring before the leaves came out? ALL forsythias produce their flowers before their leaves (as does blackthorn!) It sure aint verbena cause my verbena is a non-woody biennial. It is not buddlia as it should be in flower about now and anyway the leaves of buddlia would be darker and greyer.
As to whether it is a tree or a shrub better leave that definition to Michael (Brenock) as I usually get into trouble here. lol

There have been no flowers as yet so will have to wait until it does flower.
